Hailey Upton (Tracy Spiridakos) really set herself up for a stressful season 9. She shot and killed Roy Walton at the end of season 8, but rather than report the shooting, she agreed to let Voight (Jason Beghe) cover it up. Now, the FBI are prying into Walton’s disappearance, and it could be Upton who winds up taking the fall.

The latest Chicago PD episode, “Fractures”, puts this stress front-and-center. The FBI are running down the list of IU members and interrogating each of them in the hopes of finding a culprit. She’s not budged on her account, but the fact that Halstead (Jesse Lee Soffer) has been dragged into the mix could spell eminent doom for their relationship and careers.

Could Upton get arrested for what she did? Here’s a breakdown of everything we know about the character’s chances.

Is Upton going to jail on Chicago PD?

The episode features a tense interrogation scene in which the FBI tried to prey upon Upton’s past with domestic abuse towards women. “You know what men do. You’ve seen it your whole life,” the FBI agent noted. “You saw what Roy Walton did. One woman on your team, you saw what he did to her. Roy Walton’s dead. You covered it up.”

The promos made it seem as though Upton would crack under pressure, but the officer managed to keep it together. She upheld her part of the bargain just like Voight did, but that doesn’t mean she’s out of the woods. Towards the end of the episode, Halstead is pulled over by the FBI agent and taken out to the location where Walton’s body is buried.

The agent lays out two simple options as to what Halstead can do. He can either take the blame (and the prison time) with Upton or he can save them both and push the blame onto Voight. The episode comes to a deafening end as Halstead is faced with arguably the biggest decision of his personal and professional life.

Given how late it took Halstead to catch onto Upton’s secret, it’s ironic that he’s going to be the one to decide her ultimate fate. The couple are both looking down the barrel of a stiff sentence, and given how often Halstead and Voight have bumped heads, it seems likely that the officer would sell out his commander to salvage his career and Upton’s.

If we had to call it, we’d say Upton will not see jail time for what she did.
